Terms of Service

1. Agreement
These Terms of Service ("Terms") govern your use of the Zackly mobile application ("the App"). By downloading or using the App you agree to these Terms. If you do not agree, please do not use the App.
We may update these Terms at any time. The "Last updated" date will change accordingly. Continued use after an update constitutes acceptance.
2. Eligibility
You must be at least 13 years old to use the App. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.
3. Your Account
Accounts are device-based: an anonymous identifier is created on first launch, with a verified email address required to secure your account. You are responsible for keeping access to your device and email secure.
You can transfer your account to a new device using a one-time transfer code, which expires after 15 minutes. You can delete your account at any time in Settings → Account → Danger Zone; your data is removed within 30 days.

5. Free Tier & Ads
The Free tier includes daily usage limits and shows non-personalized ads via Google AdMob, including optional rewarded ads that grant bonus games. Paid tiers are ad-free. See our Privacy Policy for details on ad data handling.
6. Offline Content
Premium subscribers may download game content for offline use. Downloaded content is licensed for personal, non-commercial use and is accessible only while your subscription is active.
7. User Contributions
You may submit word suggestions and error reports. By submitting, you grant Zackly a worldwide, royalty-free licence to use, review, and incorporate your submission into the App. Submissions pass AI pre-screening and human review before publication.
8. Intellectual Property
All content in the App — including vocabulary and learning content in all offered languages, exercises, audio, and the user interface — is owned by or licensed to Zackly and protected by copyright and intellectual property law. You receive a limited, non-exclusive, non-transferable licence for personal use.
9. AI-Generated Content
Much of the learning content — vocabulary, translations, example sentences, reading and listening passages, and generated audio — is created or assisted by artificial intelligence. Speaking practice uses your device's speech recognition and on-device AI; feedback and conversation responses are AI-generated.
AI-generated content may contain errors and is provided for language-learning purposes on an "AS IS" basis. It is not a professional language assessment, and we make no warranty that it is complete, accurate, or free of mistakes.
10. Analytics & Notifications
The App collects pseudonymised usage analytics via PostHog only if you consent; you can withdraw anytime in Settings → Account → Usage Analytics. Push notifications are optional and controlled in Settings and your device settings.
11. Acceptable Use
You agree not to misuse the App — including attempting to circumvent subscription entitlements or usage limits, submitting unlawful or abusive content, reverse-engineering the App, or interfering with its operation. We may suspend or terminate accounts that violate these Terms.
12. Disclaimer & Liability
The App is provided "AS IS" without warranties of any kind. We do not guarantee uninterrupted access or error-free operation. To the extent permitted by law, our liability is limited to intent and gross negligence; for slight negligence, liability is limited to breaches of essential contractual obligations and foreseeable, contract-typical damage. Mandatory statutory liability (including for injury to life, body, or health) remains unaffected.
13. Governing Law
These Terms and any dispute arising from or in connection with them are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the CISG. If you are a consumer resident in the EU, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence.
We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle) under the German Consumer Dispute Resolution Act (VSBG).
